Dalrymple Declares Fire Emergency
WHEREAS, I Jack Dalrymple, Governor of the State of North Dakota, by the authority vested in me, do hereby proclaim a fire emergency for those counties and Tribal Nations in North Dakota that have issued fire declarations based on dry conditions, unseasonably warm temperatures, and high winds impacting North Dakota that started January 3, 2012, and is expected to continue; and
WHEREAS, fire weather conditions have required twenty-eight counties, the Oahe Wildlife Management Area and two tribal nations to issue fire declarations implementing burn bans and/or other fire restrictions; and
WHEREAS, dry conditions, unseasonably warm temperatures and high winds have fueled numerous fires throughout the state requiring a multi-agency response to fight wildland fires; and
WHEREAS, fire services have provided fire suppression response to save lives, protect property, private industry and natural resources from an abnormally high number of wildland fires and burn acres; and
WHEREAS, the National Weather Service has issued ten Fire Weather Watches and twelve Red Flag Warnings in North Dakota since January 3, 2012; and
WHEREAS, skilled forecast models monitored by the National Weather Service indicate a potential for drier and warmer than normal conditions through at least August; and
WHEREAS, forecasted high temperatures in combination with continued dry vegetation, low humidity and high winds increase the potential for numerous wildfires and explosive fire growth, which may be beyond the resource capabilities of local fire departments and area emergency service providers; and
WHEREAS, the U.S. Drought Monitor dated March 27, 2012, indicates drought conditions ranging from abnormally dry to moderate across the state.
NOW, THEREFORE, I order total utilization of the North Dakota State Emergency Operations Plan in order to assist local and tribal officials alleviate hardships, implement appropriate recovery actions and future mitigation measures, and facilitate restoration of services and infrastructure. I further authorize the Adjutant General to activate and make available N.D. National Guard resources in support of local and tribal governments based upon normal cost share agreements.
This order is issued upon the following authority and for the following reasons:
- The Governor is vested with the executive authority pursuant to Article V, Section 1, of the North Dakota Constitution; and
- The Governor is vested with statutory authority to issue executive orders, minimize or avert the effects of a disaster or emergency pursuant to Chapter 37-17.1 of the North Dakota Century Code; and
- A coordinated and effective effort of appropriate government departments is required to minimize the impact of emergencies and disasters in this state.
