Dalrymple Declares State Emergency in Devils Lake Basin
WHEREAS, I, Jack Dalrymple, Governor of the State of North Dakota, by the authority vested in me, do hereby proclaim a state emergency in the Devils Lake Basin, including the Spirit Lake Nation and the counties of Benson, Nelson, Ramsey and Towner, based on conditions of the dangerously high level of Devils Lake, inundating tens of thousands of acres, cutting off access on vital public roads, and posing an unacceptable risk of catastrophic overflow into the Sheyenne River; and
WHEREAS, high water levels in Devils Lake have caused serious impacts in Ramsey County, including loss of agricultural land, loss of access, isolated residents, extended response times for emergency vehicle and personnel, damage to transportation and other infrastructure; and damage to public facilities and private property; and
WHEREAS, damage to property, businesses, and the public infrastructure constitutes a serious economic hardship within the entire affected area; and
WHEREAS, it is the responsibility of the state to assist the people of North Dakota in addressing the emergencies, disasters, and other hardships that may face the state and its citizens.
NOW; THEREFORE, I order total utilization of the North Dakota State Emergency Operation Plan, its procedures, attachments, and appendices, to respond to the situation, assist local and tribal officials, alleviate hardships, and implement appropriate recovery actions and future mitigation measures to limit the hardships and impact of this emergency, and facilitate restoration of services and infrastructure.
This order is issued upon the following basis and for the following reasons:
- The Governor is vested with the executive authority pursuant to Article V, Section 1 of the North Dakota Constitution; and,
- The Governor is vested with statutory authority to issue executive orders to minimize or avert the effects of a disaster or emergency pursuant to Chapter 37-17.1 of the North Dakota Century Code; and,
- A coordinated and effective effort of all state departments is required to minimize the impact of disasters and emergencies in this state.
